This Refund and Cancellation Policy governs refunds and cancellations applicable to subscriptions to the Stunov platform operated by FiNENOV SARL (\"FiNENOV\", \"we\", \"us\"). By subscribing to the Platform, the Client acknowledges and accepts this policy.
1.1 The Client may cancel its subscription at any time through the Platform dashboard or by written notice to [email protected]. 1.2 Cancellation takes effect at the end of the current billing period. The Client retains access until the end of the paid period. 1.3 No partial refund is issued for unused time within the current billing cycle. Subscription fees are earned by FiNENOV upon the start of each billing cycle.
2.1 If the Client cancels during the free trial period, no charges are applied. 2.2 If the Client does not cancel before the trial expires and a paid subscription is activated, standard billing and cancellation terms apply. No refund is available for failure to cancel before trial expiry.
3.1 Refunds are granted solely at FiNENOV's discretion. A refund may be considered within seven (7) calendar days of the first paid subscription payment only, provided the Client has not accessed or used the Platform beyond initial setup. 3.2 No refund is available: (a) after the 7-day period from the first payment; (b) for any renewal payments; (c) for subscription downgrades or plan changes; (d) where the account has been suspended or terminated for breach of the Terms and Conditions; (e) where the Client or its Users have made substantial use of the Platform; (f) for dissatisfaction with features that were accurately described prior to subscription.
The following charges are non-refundable under any circumstances: (a) custom package setup, configuration, and migration fees; (b) onboarding, training, and consultancy services; (c) consumed SMS, push notification, email, or other communication credits; (d) third-party integration, data import, or migration services; (e) any service already delivered or made available; (f) domain registration or hosting add-on fees; (g) administrative and processing fees.
5.1 Refund requests must be submitted in writing to [email protected], including: the school name, account email, subscription reference, and detailed reason for the request. 5.2 FiNENOV will review the request and communicate its decision within fifteen (15) business days. FiNENOV's decision on refund eligibility is final and binding. 5.3 Approved refunds are processed within thirty (30) business days of approval. 5.4 FiNENOV reserves the right to deduct any costs already incurred (setup, credits consumed, services rendered) from refund amounts. 5.5 Refunds are issued via the original payment method where technically feasible; FiNENOV accepts no liability for delays caused by third-party payment processors.
6.1 Upon subscription cancellation or expiry, Client data is retained for thirty (30) calendar days to allow data export. Data export is the sole responsibility of the Client. 6.2 After the 30-day retention period, all Client data is permanently and irreversibly deleted. 6.3 FiNENOV bears no responsibility and accepts no liability for data loss resulting from the Client's failure to export data within the retention period. 6.4 Data restoration after the retention period is not available under any circumstances.
Requests for refunds outside the standard eligibility criteria (e.g., Platform outage exceeding seventy-two (72) consecutive hours directly attributable to FiNENOV, documented billing errors confirmed by FiNENOV) may be reviewed on a case-by-case basis at FiNENOV's sole and absolute discretion. FiNENOV's decision in such cases is final.
FiNENOV reserves the right to modify this policy at any time. Changes take effect thirty (30) days after notification via the Platform dashboard or email. Continued use of the Platform after the effective date constitutes acceptance.
This policy is governed by the laws of the Republic of Cameroon and applicable OHADA Uniform Acts. Disputes shall be resolved in accordance with the dispute resolution provisions of the Terms and Conditions.
